Understanding 1031 Exchanges: For real estate investors, a 1031 exchange, named after Section 1031 of the Internal Revenue Code, allows the deferment of capital gains taxes on the sale of an investment property when it is exchanged for another property of like-kind. This strategy is particularly beneficial for investors looking to upgrade or diversify their portfolios without immediately incurring a tax liability.
How 1031 Exchanges Work: To qualify for a 1031 exchange, the replacement property must be of equal or greater value than the relinquished property, and the exchange must be completed within a specified timeframe. The process typically involves:

Identifying Replacement Properties: Within 45 days of the sale, you must identify potential replacement properties. You can think of it like you have UP TO 45 days to identify properties (any unused days gets credited towards time for closing) + 135 days (+ the balance of days from identification) to close on the property or properties from which you identified, equalling a total of up to 180 days.
